Kuzma/iStockBy BILL HUTCHINSON, ABC News(MINNEAPOLIS) — Jury selection in the murder case against former Minneapolis police officer Derek Chauvin in the death of George Floyd began on Tuesday despite prosecutors asking the Minnesota Court of Appeals to halt the high-profile trial.After spending the day questioning jurors, lawyers in the case seated the first two member of the panel, a chemist for an environmental testing company who is engaged to be married to a physical therapist and a woman who said she was “super excited” to be a juror and is related to a northern Minnesota police officer.While being questioned under oath by Chauvin’s attorney, Eric Nelson, the first juror said he has never seen the viral video of Chauvin kneeling on the back of Floyd’s neck for more than nine minutes.The first pool of potential jurors were brought into the courtroom just after 9 a.m. local time and prosecutors and attorneys for Chauvin each introduced themselves.Hennepin County District Court Judge Peter Cahill said he intends to keep the jury selection process going until the appellate court tells him otherwise.Chauvin’s lawyers filed an appeal with the state Supreme Court after the appellate court issued a ruling on Friday instructing Cahill to reinstate a third-degree murder charge against Chauvin after finding that the judge erred in October when he dismissed the count.The state Supreme Court issued an order Tuesday morning acknowledging it had received the petition from Chauvin’s lawyer and giving prosecutors until 5 p.m. local time on Tuesday to file a response.Prosecutors from the office of state Attorney General Keith Ellison also filed a motion on Monday asking the appellate court to stay the trial, arguing that Cahill does not have total jurisdiction over the case while a decision over whether to include the third-degree murder charge remains pending.In opening remarks to the jury pool Tuesday, Cahill said Chauvin has pleaded not guilty to charges of second-degree murder and second-degree manslaughter, but added “charges might be added or subtracted” as the case goes on.The attorneys are looking to select 16 jurors for the case, including four alternates.Before jury selection began, lawyers on both sides of the case dismissed 16 of the first 50 prospective jurors for cause, mostly due to the answers they submitted on a lengthy questionnaire.Four of the first six potential jurors questioned on Tuesday, were dismissed. One of the potential jurors let go was a married mother of three and an immigrant from Mexico who works as a nursing assistant. Nelson exercised a peremptory challenge to dismiss the juror due to a language barrier. Nelson had also grilled the woman on her answer to why she would want to serve on the Chauvin jury, in which she wrote, “I would like to give my opinion on the unjust death of Mr. Floyd.”Another woman dismissed said she had formed an opinion on the guilt or innocence of Chauvin and did not believe it would change regardless of what evidence she heard during the trial. Also dismissed was a business manager, who on his questionnaire answered that he “strongly agreed” that police officers should not be second guessed on making split-second decisions.Nelson used another preemptory challenge to dismiss a Hispanic man who recently moved to Minneapolis from Southern California and had experience practicing martial arts.Prosecutor Steve Schleicher challenged Nelson’s move, telling Cahill the defense had made a peremptory challenge “on its second person of color in a jury pool.”“When asked to provide a race-neutral explanation for the exercise of the peremptory, the defense … articulated just sort of generalized concerns that this particular perspective juror expressed strong opinions and articulated a belief that he was simply trying to get on the jury,” Schleicher said.Pushing back, Nelson responded that the juror said he practiced Brazilian jiu-jitsu and had formed a strong opinion that Chauvin had performed an “illegal tactic” on Floyd and that Chauvin and the other officers involved in the arrest had “taken the law into their own hands.”“Yes, this juror indicated that he was willing to reexamine those opinions, but only upon essentially providing him evidence and proof contrary to his opinions is the way I understood him to say that,” Nelson said. “His statements that he would be willing to reexamine the evidence struck me as insincere.”Cahill sided with Nelson, saying that during voir dire questioning he realized the defense would probably strike the prospective juror.“That reason was not because of his race but because when he was talking about his jiu-jitsu experience and his experience with the hold is that he obviously might stick to his own opinions about being essentially an expert in the jury room,” Cahill said. “But, more importantly, he stated in a way that he was going to stick to his opinion until somebody else told him otherwise or provided proof otherwise, which essentially is shifting the burden onto the defense and not coming in with the presumption of innocence.”Copyright © 2021, ABC Audio. Scientists at Harvard-affiliated Dana-Farber Cancer Institute have identified a subtype of ovarian cancer able to build its own blood vessels, suggesting that such tumors might be especially susceptible to “anti-angiogenic” drugs that block blood vessel formation.In a study published in the online journal PloS ONE, the investigators estimate that the subtype may account for a third of all serous ovarian cancers, a common cancer of the surface of the ovaries. The discovery of the subtype, made by analyzing data from the clinical records of more than 1,500 serous ovarian cancer patients and samples of their tumors, may spur clinical trials to determine if patients with the subtype can benefit from anti-angiogenic therapies now being tested in other cancers.“Unlike breast cancer, where we can distinguish different subtypes based on their genetic signatures, ovarian cancer has been viewed as a monolithically homogenous disease — each tumor very much like every other,” says John Quackenbush, the study’s co-senior author with his Dana-Farber colleague Ursula Matulonis. “With this study, we’ve shown that serous ovarian cancer exists in at least one distinct subtype at the molecular level, raising the possibility that it will be vulnerable to therapies directed at its molecular weaknesses.”Ovarian cancer is the fifth-leading cause of cancer death for women in the United States, responsible for more than 15,000 deaths annually in this country, according to the American Cancer Society. High-grade serous ovarian cancers — the focus of the current study — are one of several varieties of tumors that appear in the “epithelial” tissue lining the ovaries. Epithelial tumors account for about half of all ovarian cancers. (“Serous” refers to tumors that are found in tissues that produce a serum-like fluid. “High-grade” refers to the highly abnormal appearance of the tumor’s cells under a microscope.)Although many ovarian cancers initially recede or grow more slowly when treated with conventional, platinum-based chemotherapy drugs, the vast majority overcome that tendency and begin to grow again.In the current study, researchers scanned the activity of thousands of genes in high-grade serous ovarian cancers from 129 patients with an advanced stage of the disease. They then sifted the data using an algorithm called rISIS, which randomly assigns the tumor samples to different groups until it finds a grouping with a distinct set of genetic characteristics. That grouping represents a potential cancer subtype.The technique yielded four possible subtypes of high-grade serous ovarian cancer, but only one of them held up when researchers applied a different technique for scanning gene activity. When researchers cataloged the genes that were particularly active — or “highly expressed” — in that single subtype, a key trend appeared: Many of the genes were known to be involved in angiogenesis, the process by which tumors build blood vessels to tap into the bloodstream for oxygen and nutrients. This distinctive array of overactive genes was dubbed the “angiogenesis signature.”A common shortcoming of gene-profiling studies is that the results often aren’t reproducible: Different labs obtain different gene signatures for the same types of cancer. To ensure their findings were not skewed by their lab procedures or testing methods, the Dana-Farber investigators analyzed data from 10 published, independent studies of gene expression in serous ovarian cancer. Together, these studies involved 1,606 ovarian cancer patients.“The analysis confirmed our finding,” said Quackenbush, a professor of computational biology and bioinformatics at the Harvard School of Public Health. “The angiogenic [blood vessel-producing] subtype is real.” When investigators analyzed the medical records of those 1,606 patients, they found that those with the angiogenic subtype tended to have more-advanced, aggressive tumors than those without the subtype.A clinical trial will be necessary to determine if angiogenesis-blocking drugs are particularly effective in patients with the angiogenic subtype. But there is reason for optimism: About 30 percent of serous ovarian cancer patients who receive angiogenesis inhibitors in a clinical trial benefit from the drugs; and the angiogenic subtype comprises about 30 percent of all serous ovarian cancers. “It is a test like this that may in the future help us select which patients will benefit most from a drug like Avastin,” says Matulonis, an associate professor of medicine at Harvard Medical School.The researchers believe that their classification of this new subtype has great potential to influence the treatment many patients receive and improve outcomes for a significant number of people with this disease. “The approach we’ve taken in this study offers a powerful way of identifying molecular subtypes of other cancers as well,” says Quackenbush.The first authors of the study are Stefan Bentink and Benjamin Haibe-Kains, of Dana-Farber and the Harvard School of Public Health. Earlier this month, IBM awarded its Watson Solutions Faculty Award to Notre Dame computer science professor Nitesh Chawla. The IBM award recognizes the work of faculty on the forefront of big data and analytics and applying that work to social problems as well as incorporating it into curriculum, according to a University press release. Chawla, who currently serves as director of both the Interdisciplinary Center of Network Science and Applications and the Data, Interference, Analytic and Learning Lab, was honored for his work with the research of big data and healthcare innovation to examine possible solutions for the future of the healthcare field. “Big data is becoming a cornerstone of the modern economy,” he said. “A lot of my research has been around data, data mining, machine learning, network science and applications, and so my Watson Faculty Award was a recognition of that work and a recognition of the curriculum.” Chawla created a multidisciplinary course at Notre Dame called Healthcare Analytics, which uses his research ideas in part as a basis for the curriculum and includes majors from multiple colleges, he said. “It may be one of the more multidisciplinary courses on campus,” Chawla said. “Students from each discipline then are focused on how we can think about data and healthcare, how data in healthcare can lead to more personalized healthcare, more cost-effective healthcare.” The South Bend healthcare community has been responsive to the research and the class, Chawla said, and many local leaders in the industry have worked with the class, including executives from Michiana Health Information Network and the chief information officer of Beacon Health System. Chawla said this kind of outside interest and involvement is important to the class as well as demonstrating why IBM was so interested in his work, especially with the creation of its new initiative, the artificial intelligence machine known as Watson. IBM popularized its Watson machine by pitting it against top human competitors on the television game show “Jeopardy!”, but its capabilities are much greater than that, Chawla said. “[The class] is sort of emblematic of the work that Watson is doing. The machine is a cognitive system which brings in data and information from a variety of sources, processes it and delivers it in a viable form,” Chawla said. “That’s what we are trying to create in the classroom environment, where you have people from different disciplines, different backgrounds, different expertise working on projects together and then delivering it in a way that would make a difference to healthcare.” The class is split up into several groups that work on semester-long projects with the goal of operating at the intersection of medicine and big data research, Chawla said.
